These terms and conditions apply to the viewing, purchasing and sale of products from Don Miele. By accessing this website or purchasing products from Don Miele, you agree to be bound by these terms and conditions.

Ownership of Materials, Trademarks and Copyright

The information contained on this website, including all images, designs, photographs, text, logos and other materials (the “Contents”), is owned by or licensed to Don Miele or is the property of the respective rights holder. The Contents may not be copied, republished, downloaded, transmitted, mirrored, distributed or reproduced for commercial purposes without prior written permission from Don Miele or the applicable rights holder.

Products and Availability

Products are offered subject to availability. Don Miele may limit quantities, withdraw products or decline an order where reasonably necessary, including because of stock availability, an obvious pricing or product-information error, suspected fraud or a legal or safety requirement. If payment has already been taken for an order that cannot be fulfilled, the affected amount will be refunded.

Product images are provided for illustration. Packaging and presentation may change, but Don Miele will take reasonable care to ensure that product descriptions are accurate.

Pricing and Payment

Prices are displayed in Australian dollars unless another currency is shown for the customer’s market. Prices may change without notice before an order is placed. The price and delivery charges shown at checkout apply to the order.

Payment is due at checkout using the payment methods made available on the website. An order is not accepted until Don Miele issues an order confirmation. Don Miele may correct an obvious pricing error before accepting an order and will give the customer the option to proceed at the corrected price or cancel for a refund.

Shipping

Shipping destinations, rates and available delivery services are shown at checkout and are governed by the Don Miele Shipping Policy. Delivery timeframes are estimates and may be affected by events outside Don Miele’s reasonable control.

For international orders, customers are responsible for complying with the laws of the destination country and for any import duties, taxes or customs charges not collected at checkout. Don Miele does not guarantee that every product can lawfully be imported into every destination.

Returns and Refunds

Returns and refunds are handled in accordance with the Don Miele Return and Refund Policy. Don Miele does not accept change-of-mind returns for opened products. Please contact Don Miele before sending any item back.

Nothing in these terms or in any Don Miele policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Warranties

Don Miele is not the manufacturer of third-party branded products. Any manufacturer’s warranty is provided in addition to, and does not replace or limit, rights available under the Australian Consumer Law. Where a product fails to meet an applicable consumer guarantee, customers may be entitled to a repair, replacement, refund or other remedy as provided by law.

Limitation of Liability

To the maximum extent permitted by law, Don Miele is not liable for indirect, special or consequential loss that was not reasonably foreseeable at the time of purchase. Don Miele is not responsible for delivery delays caused by circumstances outside its reasonable control.

This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising under applicable consumer-protection laws.

Responsible Product Use

Customers must read and follow all product labels, ingredient information, directions and warnings before use. Customers should seek advice from an appropriately qualified health professional where required. Products must not be used contrary to their instructions or supplied to a person for whom they are not intended.

Entire Agreement

These terms, together with the policies and order information displayed on this website, form the agreement between the customer and Don Miele concerning an order. If any part of these terms is found to be unenforceable, the remaining parts continue to apply.
